As of October 1, 2017 EB-1 China will once again be priority date current, making petitioners immediately eligible to receive immigrant visas. Historically almost always current, in recent years filing volume has grown so significantly that the full fiscal year’s allotment of visas in the category have been issued by the summer, forcing the Department of State to introduce a significant retrogression to slow down applications. The U.S. government’s new fiscal year begins October 1st and with it comes the new fiscal year’s allotment of visas. Clients interested in utilizing the EB-1A as a pathway to immigrate will want to move quickly to take advantage of this period where visas are immediately available.
In related news, EB-5 China has progressed 8 days from September’s bulletin and cases filed on or before June 22, 2014 are now eligible to apply for and receive immigrant visas.
